The Brief

Patrick Dewayne Smith, a 47-year-old Tennessee man, could be returned to federal prison for life after a Supreme Court ruling narrowed the use of compassionate release under the First Step Act. Smith was released in 2024 after serving 13 years of a life sentence for a nonviolent drug conspiracy conviction.

The Supreme Court ruled in May that sentencing disparities between older, harsher laws and current penalties are not "extraordinary and compelling" reasons for compassionate release. Prosecutors have since filed court documents challenging Smith's release, arguing his sentence remains legally valid.

According to FAMM, a sentencing reform group, about a dozen people nationwide could be reincarcerated due to the ruling. Smith's lawyers say he has worked two jobs, attended church, and rebuilt family ties since his release. The White House says the administration is reviewing the issue, and President Donald Trump remains proud of signing the First Step Act.

A Justice Department official said the department cannot agree to a sentence below what the law requires. Smith's father expressed frustration, noting his son's case is nonviolent.
