Federal judge says US cannot deport noncitizen students who criticize Israel

A Biden-appointed judge in Northern California just told the federal government it can't pull student visas over Gaza protest speech, and the timing tells you almost as much as the ruling itself. This wasn't some neutral arbiter stumbling onto a close legal question. It's a district known for producing outcomes that land in one predictable direction, on an issue where the administration's opponents have been hunting for a favorable venue since day one.

Here's what's actually true, though: noncitizens on student visas are guests, not citizens with an unconditional First Amendment claim to stay here no matter what they say or do. That's not a radical position. It's how visa law has worked for decades. The administration's argument was that support for groups like Hamas, or conduct crossing from protest into harassment and intimidation, is a legitimate basis for review. A judge disagreeing with the *scope* of that policy is one thing. Framing it as blanket protection for "criticizing Israel" is doing a lot of rhetorical lifting that the underlying cases don't always support.

The Stanford Daily suing to keep foreign nationals on campus regardless of what they've said or organized around isn't a free press story, it's an advocacy story wearing a journalism costume. Nobody's disputing that student journalists can report on ICE enforcement. The fight was over whether the government can act on hostile foreign nationals at all, and this ruling just made that harder.

This will get appealed, and it should be. A visa is a privilege extended to guests of this country, not a shield against consequences for aligning with groups that want Americans and our allies dead. That distinction matters, and one judge in one courtroom in San Francisco doesn't get the last word on it.
